Vouched App, Inc. (d/b/a Candor)
You must be at least 18 years old to use the Service. By using Candor you represent that you are 18 or older, that the information you provide is accurate, and that you are not barred from using the Service under applicable law. The Service is currently offered as an invitation-only private beta in the United States.
Candor is built on real identity. You agree to register and use the Service under your real name and to keep your profile information accurate. You are responsible for your account and for activity that occurs under it, and for keeping your login credentials secure. Do not impersonate anyone or misrepresent your identity or affiliations.
If you choose to provide information about your gender or who you are interested in, that information must be accurate. Misrepresenting either in order to gain access to people who would not otherwise interact with you is a violation of these Terms and may result in removal from the platform.
Vouching for and nominating other people are core features. When you provide information about another person, you take on real responsibilities.
When you write a vouch, attribute traits, nominate someone, or otherwise submit information about another person, you represent and agree that:
If you nominate or refer someone who is not a Candor member, you confirm you have a good-faith basis to introduce them and that doing so is consistent with their reasonable expectations. Do not submit another person’s contact information or personal details that you are not entitled to share.
Some nomination features let you choose whether the nominee is notified. Using these features does not change your responsibilities under Section 3.1, and we may notify or surface activity to relevant users as needed for safety and integrity.

We may remove content, and suspend or terminate accounts, that we believe violate these Terms or create risk to others.
The following are prohibited without exception, and violation will result in immediate termination:
Enforcement. We terminate accounts for violations of this Section immediately and without prior notice, and we may do so on the basis of a credible report. We preserve relevant records, report suspected child sexual exploitation to the National Center for Missing & Exploited Children as required by law, and cooperate with law enforcement regarding suspected trafficking and other criminal conduct.
You retain ownership of the content you create. To operate the Service, you grant Candor a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your content as necessary to provide and improve the Service, consistent with your visibility settings and our Privacy Policy. This license ends when your content or account is deleted, except for content retained as described in the Privacy Policy (for example, safety records and backups) and copies others have lawfully retained.
Candor responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. Notices and counter-notices must be sent to our designated agent, whose current registered details and the required contents of a notice are set out on our Copyright & DMCA page. We remove or disable access to material identified in a valid notice, notify the member who posted it, and restore material following a valid counter-notice as provided by 17 U.S.C. § 512(g). We terminate the accounts of repeat infringers in appropriate circumstances. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages.

CANDOR DOES NOT VERIFY THE CRIMINAL HISTORY OF ANY MEMBER. A VOUCH, A NOMINATION, OR AN ARCHETYPE IS THE OPINION OF THE PERSON WHO GAVE IT AND IS NOT A BACKGROUND CHECK, A SAFETY GUARANTEE, OR ANY REPRESENTATION ABOUT A PERSON’S CHARACTER, CONDUCT, OR CRIMINAL RECORD.
Candor facilitates introductions between adults, including introductions that may lead to a romantic relationship. We do not conduct background checks or identity verification on members.
You are solely responsible for your interactions with other users, online and in person. Vouches reflect the opinions of the people who write them; they are not a guarantee of any person’s character, safety, or conduct. Use good judgment, especially before meeting anyone in person. We are not responsible for the conduct of any user, and to the fullest extent permitted by law we disclaim liability for interactions between users.
Reporting. Report any user or content that violates Section 4.1 using the report control available on any profile, post, comment, or message. We review reports of trafficking, exploitation, or abuse on a priority basis.
During the private beta, the Service may include credits, boosts, and a marketplace.
1. Plans. Candor is free to use. Candor also offers optional paid memberships, currently Candor Plus and Candor Prime, each billed monthly or annually. The features included in each plan are described in the app before you buy. We may add, change or retire plans and features; changes to a plan you already pay for are covered in item 7 of this section.
2. Price. The price, billing period and currency for each plan are shown in the app before you confirm a purchase. Prices may vary by country and include any taxes the App Store collects.
3. Purchases through the App Store. On iPhone, memberships are sold through Apple's App Store. Apple processes your payment and charges it to your Apple Account. Your purchase is also subject to Apple's Media Services Terms and Conditions. Candor does not receive or store your payment card details.
4. Automatic renewal. Your membership renews automatically at the end of each billing period, for the same period and at the then-current price, unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
5. How to cancel. You can turn off auto-renew at any time in your iPhone's Settings: tap your name, then Subscriptions, then Candor. You can also open Settings ▸ Membership in the Candor app, which takes you there. Canceling stops future renewals. You keep your paid features until the end of the period you have already paid for. Deleting the app or your Candor account does not cancel an App Store subscription.
6. Refunds. Because Apple processes App Store payments, refund requests are handled by Apple under Apple's policies. You can request one at reportaproblem.apple.com. Candor cannot issue refunds for App Store purchases directly.
7. Price and plan changes. If we raise the price of a plan you subscribe to, Apple will notify you in advance as Apple's rules require and, where required, ask for your consent before the new price applies. If you do not agree, you can cancel before the change takes effect. Candor will also notify members in the app before any price change. If we materially reduce the features of a plan you pay for, we will tell you in the app before the change takes effect.
8. Account suspension or removal. If we suspend or remove your account for violating these Terms, you are not entitled to any refund, credit or other compensation from Candor for any unused part of a membership. Your App Store subscription is not canceled automatically; cancel it in your iPhone's Settings. Any refund request is decided solely by Apple. We may keep content, reports, messages and records related to the violation, including after your account is removed, to enforce these Terms, protect Candor and its members, and meet legal obligations.

1. Who the agreement is with. These Terms are between you and Vouched App, Inc. (doing business as Candor), not Apple. Candor, not Apple, is responsible for the app and its content.
2. License. We grant you a personal, non-transferable license to use the Candor app on Apple devices you own or control, as allowed by the App Store's Usage Rules, including Family Sharing where it applies.
3. Support. Candor alone provides maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
4. Warranty. If the app fails to conform to any warranty that applies, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to conform to a warranty are Candor's responsibility, to the extent these Terms do not disclaim them.
5. Product claims. Candor, not Apple, is responsible for addressing any claim by you or a third party about the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
6. Intellectual property. If a third party claims that the app or your use of it infringes their intellectual property, Candor, not Apple, is responsible for investigating, defending, settling and resolving that claim.
7. Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms. You must comply with any third-party terms that apply when you use the app, such as your wireless carrier's.
10. Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce these Terms against you as a third-party beneficiary.
These terms apply to the whole service, each only to the extent the law allows.
You are solely responsible for your interactions with other members, in the app and in person. Candor does not confirm any member's identity, background or intentions, and does not supervise meetings or conversations between members. Use your own judgment before sharing personal information or meeting anyone.
Vouches, co-signs, REP, archetypes, quiz results and similar features reflect what members share and do in the app. They are not representations, endorsements or guarantees by Candor about any person, page or business.
The service is provided "as is" and "as available." Candor makes no promise of any particular outcome, connection or compatibility, or that the service will be uninterrupted, error-free or free of harmful components.
Candor and its officers, employees and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or opportunities. Candor is not liable for the conduct of any member or third party, online or offline. Candor's total liability for any claim is limited to the greater of the amount you paid Candor in the 12 months before the claim arose or US$100.
You release Candor from claims arising from disputes between you and other members or third parties. If you are a California resident, you waive California Civil Code §1542 to that extent.
You agree to defend, indemnify and hold Candor harmless from claims, losses and costs, including reasonable attorneys' fees, arising from your content, your use of the service, your interactions with others, or your breach of these Terms.
The service relies on third parties such as Apple and RevenueCat and may link to outside sites. Candor is not responsible for their services, content or practices.
Candor may suspend or end your access at any time, with or without notice, for any violation of these Terms or to protect Candor, its members or the public. Sections that by their nature should survive termination will survive, including this section. You may stop using the Service and delete your account at any time from within the app.
We may update these Terms. We will give notice in the app of material changes before they take effect. Continued use after the effective date means you accept the updated Terms.
Before filing any claim, you agree to contact info@candortheapp.com and try to resolve it informally for 30 days. These Terms are governed by Illinois law, without regard to conflict-of-laws rules. Any claim must be brought in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction. Claims must be brought individually, not as a plaintiff or class member in any class or representative action. You and Candor waive any right to a jury trial. Any claim must be filed within one year after it arose, or it is permanently barred.
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Candor about the service. You may not assign them; Candor may assign them in connection with a merger, acquisition or sale of assets. Candor is not liable for delays or failures caused by events beyond its reasonable control.
