Notices sent to any other address or contact may not reach the designated agent and may delay our response.
To be effective under 17 U.S.C. § 512(c)(3), a written notification must include substantially all of the following six elements:
We remove or disable access to the material identified, and we take reasonable steps to notify the member who posted it, including providing a copy of the notice.
If your material was removed or disabled and you believe that was the result of mistake or misidentification, you may send a counter-notification under 17 U.S.C. § 512(g)(3) to the designated agent above. It must include substantially all of the following:
On receiving a valid counter-notification we forward it to the person who sent the original notice. Unless that person notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may replace the removed material or restore access to it in not less than 10 nor more than 14 business days following receipt of the counter-notification, as provided by 17 U.S.C. § 512(g)(2).
We have adopted and reasonably implement a policy that provides for the termination, in appropriate circumstances, of the accounts of members who are repeat infringers. See Terms of Service § 5.1 and our Acceptable Use Policy.
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages — including costs and attorneys’ fees — incurred by the alleged infringer, by any copyright owner or its authorised licensee, or by a service provider, who is injured by the misrepresentation.
