2. Sending a notice of claimed infringement

To be effective under 17 U.S.C. § 512(c)(3), a written notification must include substantially all of the following six elements:

• A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single site are covered by a single notification, a representative list of those works.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — for Candor, that normally means the profile, post, comment, vouch, or message, and the account it appears on.
• Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. What happens when we receive a valid notice

We remove or disable access to the material identified, and we take reasonable steps to notify the member who posted it, including providing a copy of the notice.

4. Counter-notification

If your material was removed or disabled and you believe that was the result of mistake or misidentification, you may send a counter-notification under 17 U.S.C. § 512(g)(3) to the designated agent above. It must include substantially all of the following:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or access was disabled.
• A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, and telephone number.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, of any judicial district in which we may be found — and that you will accept service of process from the person who provided the original notification, or an agent of that person.

On receiving a valid counter-notification we forward it to the person who sent the original notice. Unless that person notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may replace the removed material or restore access to it in not less than 10 nor more than 14 business days following receipt of the counter-notification, as provided by 17 U.S.C. § 512(g)(2).

5. Repeat infringers

We have adopted and reasonably implement a policy that provides for the termination, in appropriate circumstances, of the accounts of members who are repeat infringers. See Terms of Service § 5.1 and our Acceptable Use Policy.

6. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages — including costs and attorneys’ fees — incurred by the alleged infringer, by any copyright owner or its authorised licensee, or by a service provider, who is injured by the misrepresentation.
